NY AG Probes Intel Marketing Practices
New York State Attorney-General Andrew Cheng cuomo is investigating possible violations of state and federal antitrust law, by Intel, the worlds largest appliance maker of computer microprocessors.
1 cuomo spokesman said that the summonses were delivered Thursday to find information, whether forced Intel, Advanced Micro Devices, Inc. exclusion, known as AMD, from the market for a particular computer processing unit.
Cuomo said that his preliminary review indicated that the need for a comprehensive investigation.
Subpoena seeking information on Intels pricing strategy and whether the company would be punished, computer manufacturers, distribution channels cut off competitors, as well as inappropriate for the subscriber exclusive.
"We focus on the investigation is to determine whether the company has improperly used monopoly power to exclude competitors or stifle innovation," said cuomo. "We will look at whether the company is abusing its power to eliminate the threat of competition or harm competition, in violation of New York and federal antitrust law." Intel said it has broken no laws, despite the ongoing legal action several times around the world, Intel is AMDs drive, its nearest competitor.
"We believe our business practices are lawful, and said:" Intel spokesman Muluoyi. "We also believe that in the microprocessor market is a highly competitive market and mode of operation, people will look forward to a competitive market operation." He said that the concerns raised in its cuomo releases in a mirror, a private litigation, AMD in 2005 in the United States Federal Court of the establishment of the State of Delaware in the United States. An AMD spokesman for the company declined to comment.
Cuomo probe in the issue is whether AMD has a fair chance to supply its X86 computer processing units for desktop and notebook computers and servers.
Cuomo said Intel commanded 80% of the 30 billion US dollars market.
AMD claims of the Delaware litigation bully Intels major customers - PC manufacturers such as Dell - into decision-making exclusive agreement, and to provide secret kickbacks. AMD said that anti-competitive practices in a number of countries, including the United Kingdom, Germany and Japan.
Intel, which commands, including three-quarters of the worlds microprocessor market, has denied AMDs allegations and defended its business practices as legal and beneficial to consumers.
U.S. regulators appear to be a formal probe against Intels marketing practices, despite requests from members of Congress and AMD.
August of this year, Democratic Senator Charles Schumer and Congressman Kirsten gillibrand demanded that the United States Federal Trade Commission to investigate the company. Wrote to the Federal Trade Commission, by two New York Democrats, said: "If the allegations against Intel are true, there are likely to harm consumers, can be profound." In response to September this year, the Federal Trade Commission said that the legislators of the body is prohibited by law disclosure of the investigation. October, AMD released nearly 400 million yuan loss for the quarter ended in September. The company announced that its earnings per share in the same period of 1.86 billion US dollars.
Last month, AMD CEO Hector Ruiz said that the chip maker has been committed to breaking even in the second quarter of 2008 and return to profitability in the third.
